- A woman who was driving the family sedan with several of her minor children as passengers was struck nearly head-on by a Billings School Bus. She suffered severe neck pain, numbness of her arms and legs, trembling of her feet, and complained of bladder problems. These symptoms made it very difficult for her to work and to care for her family. After seeing several doctors who diagnosed her to be suffering from a relatively minor soft tissue, "whiplash" injury of the neck, she was told by several attorneys that her claim was not worth much. She then hired me and with proper medical workup, it was discovered that she actually had sustained a contusion or bruise of her spinal cord. I was able to obtain a seven-figure total money settlement for this woman and also obtained smaller settlements for her injured children.
- I represented a woman who suffered serious disabilities as the result of stroke symptoms which went undiagnosed for an extended period of time by her primary care physician. The medical malpractice insurance company denied any negligence on the part of the subject doctor, and I therefore presented a complicated medical malpractice claim before the Montana Medical-Legal Panel as required by Montana law. This Medical-Legal Panel, composed of three doctors and three attorneys, rendered a favorable decision, and shortly thereafter I was able to settle my client's claim for a very substantial amount.
- I represented a man who was involved in a very severe motor vehicle collision in which he was thrown from his vehicle. Within a short time after the collision, it was discovered that my client was suffering from several collapsed vertebrae in his back but that this process had actually begun before the collision ever occurred. Obviously, there was a question as to how much the collision contributed to this condition. I was able to persuade my client's treating neurosurgeon that based upon my client's past medical history, most of the symptoms he was suffering were caused by the collision. The insurance company then agreed to pay for a special surgical procedure to restore my client's collapsed vertebrae, and he was eventually able to return to work. I settled this claim for multiple six figure insurance policy limits.
- I also represented a woman who was riding in a vehicle traveling approximately 60 miles per hour when a vehicle approaching from the opposite direction lost control on an icy road and collided nearly head-on with my client's vehicle. Initially, my client had relatively minor neck symptoms, and the insurance company made some attempts to settle her claim prior to my representation. However, with the passage of time, it became obvious that my client had suffered significant neck injuries in the form of a herniated disc which required a neck fusion. She has been able to return to her original job. I settled her claim with the other driver's insurance company for six-figure policy limits. However, since I believed her injuries justified much higher compensation, I made claims against her own insurance company for underinsured motor vehicle coverage. This coverage was substantial because it involved motor vehicle coverage on multiple vehicles and multiple policies, all of which my client was not aware until my representation. These underinsured claims settled for the policy limits.
